The provider has confirmed significant financial instability and is imminently entering formal insolvency proceedings, necessitating urgent intervention to safeguard vulnerable residents and ensure continuity of essential care services. Any delay would present an unacceptable risk of disruption to care provision and potential harm to individuals. In light of the requirement to have contingency arrangements fully operational by 1 December 2025 at the earliest, it is not practicable to comply with the 28-day notice requirement under Part Four, Section D, Rule 13, the 5-day notice requirement under Part Four, Section D, Rule 4, the General Exception procedure under Part Four, Section D, or the Call-In Procedure Rules under Part Four, Section H. The circumstances constitute an exceptional and unforeseeable situation requiring immediate action in the public interest
