Review of Right to Buy Lease

Proposed changes to the existing lease to include the following:                                                                                                                                          • Gas certificates – leaseholders should submit them annually, if not the landlord will undertake the work and recharge it to the leaseholder.

• All future health and safety related works (such as internal wiring, smoke alarms etc) carried out by the landlord in the building should include leasehold properties on a rechargeable basis.

• Landlord should be able to carry out internal repairs when leaseholders request them and recharge them as part of their service charges.

• Management fee – reasonable method of apportionment rather than block and estate.

• Recovery of litigation costs (cost of LVT if allowed)/ interest on arrears and admin costs in respect of late payments

• Sinking fund for future major works

• Annual fee for subletting - the  subletting of properties should not be permitted for the first five years (in line with the period for the statutory provisions for the repayment of the discount). They should also have to seek the landlord's permission  before they sublet.

The proposals will be consulted on with tenants at the Tenancy and Estate Management Resident Panel on 8 May 2012 and with leaseholders at the Leasehold Panel on 17 May 2012
