Tiwa 'n' Tiwa, 77 West Green Road, London N15 5DA

To consider an application for a new premises licence.

Minutes:

Daliah Barrett, Licensing Officer, introduced the application for a new premises licence at Tiwa ‘n’ Tiwa, 77 West Green Road.  Mr Adeyemi had recently purchased the premises, and wished to apply for regulated entertainment and sale of alcohol.  Ms Barrett informed the Committee that the opening hours applied for Monday-Wednesday were 1200-0000, and not 1200-2200 as stated in the pack.  The Police had requested that the finish times for licensable activities be pulled back by 30 minutes, and this had been accepted by the Applicant.  One letter of representation had been received from a local resident, who was unable to attend the hearing.  Ms Barrett requested clarification from the Applicant with regard to the opening times for special days (Christmas and New Year), and was informed that the premises would not be open on Christmas Day or New Years Day, and that the hours would remain the same for all other days.

 

Mr Adeyemi, Applicant, presented his application for a new premises licence.  He owned another premises in Southwark and considered himself to be a fit and proper person to run these premises.  He had complied with all conditions put forward by the Police and Enforcement Response, and had installed CCTV.  The premises was a family oriented restaurant, and it was normal for alcohol to be consumed with meals.  Music would be played at a low level, in the background. 

 

In response to questions from the Committee, Mr Adeyemi confirmed that he had soundproofed the inside of the restaurant so that noise should not be able to be heard in the residences above the premises.

 

The Chair thanked Mr Adeyemi for attending the meeting and informed him that the decision would be notified to him following the meeting.

The Committee carefully considered the application for a new premises licence, the representations of a local resident, the Council’s Statement of Licensing Policy and the s182 guidance.

 

The Committee resolved to grant the application as follows:

For consumption ON and OFF the premises.

 

The Committee considered the representations, and the evidence that the premises are located in close proximity to residential properties, with flats above the premises.  It therefore considered it appropriate to restrict the hours of opening and the licensable activities on a Sunday to the same hours as during the week (Monday – Thursday).

 

The Committee considered it appropriate to impose a condition that when regulated entertainment is taking place the windows and doors of the premises should be kept shut.  This was so as to ensure that the levels of noise emanating from the premises were kept to a minimum, again because of the close proximity to residential properties.

 

The Committee heard evidence that the applicant is an experienced licensee and intends to run a family restaurant, with alcohol being sold with meals although he has also applied for a licence for alcohol to be consumed off the premises.  The Committee did not therefore consider that the concerns raised by the local resident about the premises effectively being a nightclub, because of the late opening, were likely to be realised.  Therefore there was no evidence that the licensing objective of the prevention of crime and disorder / public nuisance and public safety would be undermined by the granting of the licence.

 

The Committee noted that the premises would be closed on Christmas Day and New Years Day.
