FILMING AT MEETINGS

Please note this meeting may be filmed or recorded by the Council for live or subsequent broadcast via the Council’s internet site or by anyone attending the meeting using any communication method.  Although we ask members of the public recording, filming or reporting on the meeting not to include the public seating areas, members of the public attending the meeting should be aware that we cannot guarantee that they will not be filmed or recorded by others attending the meeting.  Members of the public participating in the meeting (e.g. making deputations, asking questions, making oral protests) should be aware that they are likely to be filmed, recorded or reported on.  By entering the meeting room and using the public seating area, you are consenting to being filmed and to the possible use of those images and sound recordings.

 

The Chair of the meeting has the discretion to terminate or suspend filming or recording, if in his or her opinion continuation of the filming, recording or reporting would disrupt or prejudice the proceedings, infringe the rights of any individual, or may lead to the breach of a legal obligation by the Council.

The Committee carefully considered the application for a review of the premises licence, the representations of the Trading Standards team and the licence holder, the Council’s Statement of Licensing Policy and the s182 guidance.

 

The Committee resolved to modify the conditions of the licence to incorporate the recommendations in the Trading Standards representation set out on page 62 and 63, points 1-10 of the Committee agenda pack.

 

The Committee had careful regard to the fact that criminal activity had taken place at the premises and noted that the licence holder had entered a guilty plea in relation to the offence and was subsequently fined in connection to that offence. The Committee considered whether it would be appropriate to suspend the licence but decided in this instance that although the offence was serious, it would afford the licence holder a further opportunity to demonstrate that he would comply fully with the law and his obligations as a licence holder.  The Committee recognised that a suspension of the licence could have a serious impact on the licence holder’s business but wanted the licence holder to be aware that should this matter come before the Committee again, it would take a dim view of any repetition of the activities highlighted in this review.

 

The Committee strongly recommend that the licence holder attend further licensing training at the earliest opportunity.

 

The Committee approached its enquiries with an open mind and only made its decision after having heard from all parties.
