DECLARATIONS OF INTEREST

A member with a disclosable pecuniary interest or a prejudicial interest in a matter who attends a meeting of the authority at which the matter is considered:

 

(i) must disclose the interest at the start of the meeting or when the interest becomes apparent, and

(ii) may not participate in any discussion or vote on the matter and must withdraw from the meeting room.

 

A member who discloses at a meeting a disclosable pecuniary interest which is not registered in the Register of Members’ Interests or the subject of a pending notification must notify the Monitoring Officer of the interest within 28 days of the disclosure.

 

Disclosable pecuniary interests, personal interests and prejudicial interests are defined at Paragraphs 5-7 and Appendix A of the Members’ Code of Conduct

The Committee considered the report, presented by the Licensing Officer, Daliah Barrett, on the application for a premises licence variation at Teddy’s Off Licence, 68B/C Bruce Grove, London N17. It was reported that a letter of representation had been received from one interested party, objecting to the application on the grounds of crime and disorder and public nuisance.

 

Mr Yildiz, objecting to the application, addressed the Committee and explained the reasons for his objection:

 

  • There were too many off licences in the area, this would lead to competition on price and cheap alcohol, which would then lead to crime and antisocial behaviour.
  • As someone working in the area, Mr Yildiz had experienced first hand the problems caused by people under the influence of alcohol, and a 24 hour licence at this premises would make the problems worse and attract more people to the area.
  • People who had been drinking caused noise nuisance and litter, which damaged the area.

 

In response to questions from the Committee to Mr Yildiz, the following points were discussed:

 

  • Mr Yildiz advised that he worked in a nearby off-licence, which opened from 6am-1am. He felt that he was particularly affected by issues caused by people who had been drinking, as he worked directly with the public in his shop.
  • It was reported that there had been more problems since Teddy’s had opened, as there had been a reduction in alcohol prices in the area and attracted more drunk and disorderly people to the area.
  • In response to a question from the Committee, Mr Yildiz advised that the price competition he referred to was between the shop he worked in and Teddy’s Off Licence.

 

Mr Waites addressed the Committee on behalf of the applicant and made the following points:

 

  • It was material that no representation against the application had been submitted by the Police, as the main source of advice on crime and disorder. Environmental Health and the Licensing Authority had also expressed no concerns regarding the application.
  • Any objections on the basis of trade should be treated with less weight.
  • The points raised by the objector had been very general in nature, and were not supported by evidence. Crime statistics for the months before and after the premises had opened had remained consistent, no problems had arisen as a result and the premises was operated in line with good practice and robust management arrangements.
  • The premises was already open for 24 hours, this application was simply to match the hours for the sale of alcohol to the opening hours. It was noted that the neighbouring premises also had a licence for the 24 hour sale of alcohol.
  • The conditions proposed in the operating schedule were robust; if the Committee felt it necessary, the applicant would offer an additional condition relating to litter.

 

In response to questions from the Committee to the applicant’s representative, the following points were covered:
