RESOLVED that Councillor Browne act as Chair of the Sub Committee.

An apology for absence was received from Ms Simpson who objected to the application.

Urgent Business

It being a special meeting of the Sub Committee, under Part Four, Section B, Paragraph 17, of the Council’s Constitution, no other business shall be considered at the meeting.

As it was a special meeting no items of urgent business were permitted.

Declarations of Interest

A member with a personal interest in a matter who attends a meeting of the authority at which the matter is considered must disclose to that meeting the existence and nature of that interest at he commencement of that consideration, or when the interest becomes apparent.

                                                                                

A member with a personal interest in a matter also has a prejudicial interest in that matter if the interest is one which a member of the public with knowledge of the relevant facts would reasonably regard as so significant that it is likely to prejudice the member’s judgement of the public interest and if this interest affects their financial position or the financial position of a person or body as described in paragraph 8 of the Code of Conduct and/or if it relates to the determining of any approval, consent, licence, permission or registration in relation to them or any person or body described in paragraph 8 of the Code of Conduct.

There were no declarations of interest in relation to items on the agenda.


It was noted that an article on the application for 90 Trinity Road had appeared in the Tottenham Journal but it had not disclosed any information that was not included in the public agenda pack.

To consider the application to vary a premises license for 90 Trinity Road, N22 8YB.

The Licensing officer introduced the application to vary a premises licence for 90 Trinity Road, London, N22 8YB to extend the hours for the supply of alcohol and it was noted that the Police Representation had been withdrawn further to the Applicant agreeing to the proposed condition.

 

Further to questions to the Licensing Officer it was noted that all previous conditions relating to the original licence would remain in place and that the Applicant would monitor the premises to ensure that customers did not congregate outside and would report any anti-social behaviour to the Police.

 

The Committee received the statement from the Applicant’s Representative including that there was a need to open the premises later due to demand and for the business to survive.  The sale of alcohol was monitored and the Applicant had agreed to adopt the Challenge 21 initiative and the relevant training was provided to staff on induction.  There was no history of involvement in any incidents with the Police since the Applicant  had been running the premises.

 

The objectors and applicant’s representative had the opportunity to sum up their cases, and the Committee retired to deliberate.

 

The Panel carefully considered the application and representation of all responsible authorities, the local residents and the applicants and took into account the Licensing Policy and Section 182 of the guidance and:

 

RESOLVED

 

To grant the application by Erdal Celebi for a premises license variation in respect of 90 Trinity Road, London, N22 8YB under the Licensing Act 2003 in the following terms:

 

Supply of Alcohol from Sunday to Saturday:    07:00 hrs to 12:00 hrs midnight

(i.e. 7 days a week)

 

Opening Hours from Sunday to Saturday:        07:00 hrs to 12:00 hrs midnight

(i.e. 7 days a week)

 

The conditions outlined by the Metropolitan Police on page 24 of the agenda pack and the Challenge 21 conditions on page 26 of the agenda pack are to be implemented. 

 

For the avoidance of doubt the variation of the premises license is only to be granted once the licensing authority has provided written confirmation to the applicant that it has been satisfied that all the required conditions have been met to the satisfaction of all authorities.

 

The licence will be subject to a review if the conditions are not met.
