(Report of the Interim Director or Children’s Services). The report sets out the decision of the Octagon Pupil Referral Unit (PRU) management committee to convert to Academy Status and seeks approval for the Local Authority to enter into a commercial transfer agreement; a lease for one hundred and twenty-five years, where the Local Authority is the freeholder and; a novation and/or assignment of any building contracts as appropriate.

The Leader of the Council considered a report, previously circulated, which set out the decision of the Octagon Pupil Referral Unit (PRU) Management Committee to convert to Academy Status and that also sought agreement to a number of measures to facilitate the statutory process for the conversion.

RESOLVED:

1. That the decision of the Octagon Pupil Referral Unit Management Committee to convert to Academy Status be noted.

2. That, in order to facilitate the statutory process and conversion of the PRU to Academy status, approval be given to entering into the following:

a)      A Commercial Transfer Agreement

b)      A lease for 125 years where the Local Authority is freeholder

c)      Novation and/or assignment of any building contracts as appropriate

3. That approval be given to authority being delegated to the Director of Children’s Services / Assistant Director for Schools and Learning, in consultation with the Cabinet Member for Children’s Services, to agree the final terms of the documents detailed in paragraph 3.2 of the report and to enter into these agreements.

Alternative options considered

None – this is a statutory process following the exercise of the educational establishments’ discretion to choose to convert to academy status under the Academies Act 2010.
