Minutes:

Apologies were received from Cllr Peacock who was substituted for by Cllr Patel. Apologies were received from Cllr Mughal who was substituted for by Cllr Beacham.

The Chair will consider the admission of any late items of urgent business.  (Late items will be considered under the agenda item where they appear.  New items will be dealt with at Item 8 below).

DECLARATIONS OF INTEREST:

A member with a personal interest in a matter who attends a meeting of the Authority at which the matter is considered must disclose to that meeting the existence and nature of that interest at the commencement of that consideration, or when the interest becomes apparent.

 

A members with a personal interest in a matter also has a prejudicial interest in that matter if the interest is one which a member of the public with knowledge of the relevant facts would reasonably regard as so significant that it is likely to prejudice the member’s judgement of the public interest.

To consider  an application to provide a licensable activity in the form of the sale of alcohol, Late Night Refreshment, and Regulated Entertainment.

Minutes:

The Sub-Committee was informed that this application had been withdrawn.

EXCLUSION OF THE PRESS AND PUBLIC:

The following item is likely to be the subject of a motion to exclude the press and public as it contains exempt information relating to the business or financial affairs of any particular person (including the Authority holding that information).

It was resolved that the press and public be excluded as the following agenda item concerned information relating to a named individual.

APPLICATION FOR A PERSONAL LICENSE UNDER THE LICENSING ACT 2003.

Application for a Personal Licence

Minutes:

The applicant had made an application under the provisions of the Licensing Act (2003) for a personal licence to sell alcohol. He had undergone the required training for this licence.

 

However, the applicant had an unspent conviction. The conviction was for a relevant offence (drink driving). He had been convicted of drink driving in 2002 and had been fined £200 and banned for driving for 12 months (later reduced to 9). The Metropolitan Police therefore had lodged an objection to the application.

 

Furthermore, on one part of the licensing form, it was indicated that the applicant had no relevant convictions even though the drink driving conviction was mentioned elsewhere. The applicant responded that the form had been completed for him by Positive Licensing Ltd, as he was not that fluent in English. He said the error was a clerical error by Positive Licensing.

 

The Sub-Committee resolved that:

  • Having heard the evidence, including the objection  from the police service, the Sub-Committee did not consider it necessary for the promotion of the crime prevention objective to reject the application and, therefore, the licence is to be granted.
