Declarations of Interest

A member with a personal interest in a matter who attends a meeting of the authority at which the matter is considered must disclose to that meeting the existence and nature of that interest at he commencement of that consideration, or when the interest becomes apparent.

 

A member with a personal interest in a matter also has a prejudicial interest in that matter if the interest is one which a member of the public with knowledge of the relevant facts would reasonably regard as so significant that it is likely to prejudice the member’s judgement of the public interest and if this interest affects their financial position or the financial position of a person or body as described in paragraph 8 of the Code of Conduct and/or if it relates to the determining of any approval, consent, licence, permission or registration in relation to them or any person or body described in paragraph 8 of the Code of Conduct.

To consider an application to assign a new designated premises supervisor at the public house.  The current licensable activities are sale by retail for consumption on and off the premises, and regulated entertainment in the form of music and dancing.

Ms Barrett, the Licensing Officer, advised the Committee that there had been some development between the parties.  The Police representative and the applicant Admiral Taverns had agreed to an adjournment, as the representative of Admiral Taverns would like the opportunity to reapply for a different designated premises supervisor.

 

The Police representative addressed the Committee and advised that if the licensee was the new designated premises supervisor in the near future then their representations would be withdrawn.

 

The Committee agreed to adjourn the application until a future date of the Sub Committee.

 

RESOLVED

 

That the application be adjourned until a future date of the Sub Committee.

At the start of the item the Chair clarified whether any parties had additional documents they wished to submit.  In response two objectors requested to table photographs of the premises taken that morning.  The applicant’s representative objected to the photographs being tabled as they did not provide a printed date and time on them.

 

The Licensing Officer presented the report and outlined the purpose and recommendations.  Ms Barrett explained that background and the details of the application being sought for a new premises licence.  The licensing officer further explained the relevant representations received from the Metropolitan Police, planning officer and interested parties who were in attendance.  The Licensing Officer further informed the Committee that at the time of writing the report it was confirmed that the applicant had not applied for a personal licence and so could not be assigned to the role of the designated premises supervisor, there could be no sale of alcohol on the premises.

 

The objectors queried whether the application was submitted in the name of Mr or Mrs Sumbul.  The licensing officer clarified that the application was made on behalf of Mr Sumbul.  The Objectors further enquired whether the Members had seen the premises.  The Chair confirmed that site visits were anonymously made by the Committee.

 

Local residents objected to the application on the basis that another premises selling alcohol would be detrimental to an already rowdy area.  There was no need for the sale of alcohol from 9am until 11pm as this would not create a positive effect on the environment.  Concern was raised regarding the amount of litter and cigarette ends in the street, there was further noise nuisance of patrons congregating outside the premises, particularly on Wednesday nights.  The patrons were regularly standing in the street smoking, drinking and all night activities were taking place in the premises for example, playing cards. 

 

In response to questions raised by the Committee the local objectors replied that there was a small forecourt at the side of the premises where two or three tables and chairs could be placed for patrons to sit outside.  It was confirmed that none of the objectors had in the past reported noise nuisance to the Noise Team in respect of the premises.

 

The applicant’s representative informed the Committee that the application had been advertised and applied for properly.  Representations had been received from the Police in relation to the hours of operation and the hours for the sale of alcohol being the same.  It was recommended that the hours for the sale of alcohol should be reduced by 15 minutes each day.  The applicants had amended their application accordingly and that the premises would not cause crime and disorder or be unsafe to the public.  The representative confirmed that the applicant would be willing to supply a cigarette bin outside the premises for patrons to extinguish their cigarettes and further that only three patrons would be allowed outside to smoke at any one time.  It was not the intention  ...  view the full minutes text for item 7.

The Committee was advised that the objector had not arrived at the meeting.  The Legal Officer clarified the Committee’s position and advised that under the Council’s procedures, non attendance of party or parties, the Chair decides to:

 

  1. grant a adjournment to another date
  2. proceed in the absence of the non attending party.  Normally, an absent party would be given one further opportunity to attend the hearing.

 

The Committee considered the options and decided to adjourn the hearing until a future date of the Committee.

 

RESOLVED

 

That the application be deferred until a future date of the Committee.
