A member with a personal interest in a matter who attends a meeting of the Authority at which the matter is considered must disclose to that meeting the existence and nature of that interest at the commencement of that consideration, or when the interest becomes apparent.

 

A member with a personal interest in a matter also has a prejudicial interest in that matter if the interest is one which a member of the public with knowledge of the relevant facts would reasonably regard as so significant that it is likely to prejudice the member’s judgement of the public interest.

To consider an application for a NEW Premises License.

RESOLVED

 

The Committee decided to grant the application subject to the following conditions:

 

(i)                 Standard mandatory condition as provided for by section 19 of the Licensing Act 2003.

(ii)               Conditions to enforce the recommendations of the Child Support Agency.

(iii)             Conditions to enforce the provisions of the Operating Schedule.

(iv)              With respect to standard days and timings: all licensable activities to cease by 02:00am daily.

(v)                With respects to standard days and timings: the premises to be closed to the public by 02:30am daily.

(vi)              With respect to non-standard timings, the hours are granted as follows:

·           The provision of Late Night Refreshment and Regulated Entertainment  to cease by 03:00am;

·           The Sale or Supply of Alcohol to cease by 04:00am;

·           The premises to be closed to the public by 05:00am.

 

REASONS:  The Committee has decided that it is necessary tp restrict the operating hours,  as set out at items (iii) to (vi) above, in order to promote the public nuisance licensing objectives.  The reason for this decision is that the Committee believes that these restrictions will ensure that the use of the premises for the carrying on of licensable activities does not cause nuisance to neighbouring occupiers.

 

(vii)            That use of the outside rear space of the premises for the carrying on of licensable activities to cease by 12am (midnight) daily, all days of the year.

(viii)          The outside rear space of the premises to be closed to the public by 12am (midnight) daily, all days of the year.

 

·           INFORMATIVE:  The Licensee is not permitted to sell or supply alcohol at or from the premises until such time as there is a designated premises supervisors for the premises.
