APOLOGIES FOR ABSENCE

Minutes:

As this was a meeting that is taking place between the Local Government Election and the Council’s AGM on 22 May 2006, in accordance with agreed procedures, it was necessary to elect a Chair for the proceedings. The Committee Clerk called for nominations for the position of this meeting. There was one nomination in the form of Councillor Patel. The other Licensing Committee members subsequently unanimously agreed to Councillor Patel Chairing this meeting.

SHELTON HOTEL, AL-MANSOOR AND TANDOORI RESTAURANT, 60 Wightman Road, N4 (Harringay ward):

To consider an application for a Premises License to provide a licensable activity in the form of Late Night Refreshment and Regulated Entertainment.

RESOLVED

              

The Committee has decided to grant the amended application subject to the following conditions:

 

(i)                 Opening hours for the restaurant:

Monday to Sunday – 08:00 to 02:00

 

(ii)               Provision of late night refreshments:

            Monday to Sunday – 23:00 to 01:30

 

(iii)             Provision of regulated entertainment:

            Monday to Sunday – 08:00 to 02:00

              

The reasons for these decisions were to ensure that customers have time to consume their refreshments, in order to ensure that public nuisance is minimised, because of residential premises nearby.

 

(iv)              Security staff are to be SIA certified.

 

(v)                Conditions to enforce the operating schedule.

 

(vi)              Standard mandatory conditions are enforced (ss.21 of the Licensing Act 2003).

 

INFORMATIVE

 

This licence does not constitute a consent under any other regime. It is necessary for the licensee to obtain any other consents that may be necessary for the lawful operation of the premises, including planning consent.

The Committee decided to grant in part the application subject to the following conditions:

(ii)               Standard mandatory conditions are enforced (ss.21 of the Licensing Act 2003).

 

(iii)             Opening hours for public:

                                    Monday to Sunday – 08:00 to 02:00

 

(iv)              Provision of late night refreshments:

                                    Monday to Sunday – 23:00 to 01:30

 

(v)                Supply of alcohol:

                                    Monday to Sunday – 22:00 to 01:30

 

INFORMATIVES

 

(i)                 That the licence granted would not constitute consent under any other regime. It would be necessary for the Licensee to obtain any other consent that may be necessary for the lawful operation of the premises, including planning consent.

(ii)               It is an offence to carry on, or attempt to carry on, a licensable activity at these premises otherwise than under and in accordance with an authorisation (namely, a premises licence, a club premises certificate or a valid temporary event notice). It is also an offence for a person to allow a licensable activity to be so carried on. A person found guilty of such an offence is liable on summary conviction to imprisonment for a term not exceeding six months, or to a fine not exceeding £20,000, or to both.

The Committee decided to grant the application in full but with the following conditions:

 

(i)                 Alcohol may only be sold to individuals over the age of 18 with valid proof of identification with one of the following:

 

·                    A valid passport

·                    A photo driving license issues in a EU country

·                    A proof of age standard card system

·                    A citizen card, supported by the Home Office

 

(ii)               Conditions to enforce the operating schedule.

To consider an application for a vary to a premises licence to provide a licensable activity in the form of Supply of Alcohol, Provision of Regulated Entertainment and Provision of Entertainment.

After receiving the Licensing Officer’s report on this application, and considering the views of the objectors to the application, the Chair of the Committee proposed to adjourn the hearing. This decision was unanimously agreed by Committee members on the grounds that further information had come to light from the applicant which all interested parties would need time to consider in accordance with the procedures of the Committee under the Licensing Act 2003.
