336 North London Waste Plan - Non Adoption and Revision

The report recommends that the Planning Inspectorate should be requested to formally write to the Local Authority setting out its reasons for recommending non-adoption of the North London Waste Plan (NLWP).

Cabinet considered a report, presented by the Cabinet Member for Economic Regeneration and Social Inclusion, which outlined the current position with respect to the North London Waste Plan (NLWP) and the Planning Inspector’s recent ruling that the NLWP did not comply with the legal requirements of the Duty to Cooperate.
The Cabinet Member noted that the Duty to Cooperate had been introduced by the Government shortly before the NLWP was submitted to the Planning Inspector. At the time the NLWP had been in preparation for over five years and therefore meeting the new requirements of the Duty to Cooperate, without transitional arrangements being put in place, had been problematic.

Alternative Options Considered
There are no alternative options. This planning policy is currently required and Local Authorities are required to carry out planning policy development and site identification process.

In line with section 120 of the Planning and Compulsory Purchase Act 2004.
