Decision:

To approve the direct award appointment to Formation Design and Build Ltd at the quoted price of £29,565.11 for the provision of disabled adaptations to 4 Disability Discrimination Act (DDA) compliant properties at the development known as Nilgün Canver Court N22.

Reasons for the decision:

Formation Design and Build Ltd, as the construction contractor for the development known as Nilgün Canver Court, have completed and handed over the 80 properties out of which 8 are (DDA) compliant.
Following Occupational Therapist Assessment, 4 of the properties (51,53,58 & 65) have been deemed suitable for bespoke adaptations to meet the needs of the identifies clients. As the building was constructed by Formation Design and Build Ltd, they have in depth knowledge of the layout of the properties, structural elements, services and components used and will remain the single source of accountability for any subsequent defects and will not invalidate any existing warranties. Formation DBL is a strong construction partner with LBH and can be relied on to deliver a quality bespoke adaptions to the identified properties. There will be very little lead in time and will enable the identified customers to occupy the much-needed properties quicker and allowing the Council to reduce our void loss.

Alternative options considered:

The Council could choose to seek competitive tenders from other contractors. This option was rejected as other contractors have no knowledge of the construction method and will take longer for them to ascertain such information and critically will have adverse impact on warranties issued by Formation with no clear single source of accountability for any resultant defects in the DDA units. This will cause delays and uncertainties all of which does not accord with the Councils priority to tackle the ongoing housing crisis.
