It is recommended that the Assistant Director
of Housing approves the implementation of Contract Standing Order
10.02 to extend Martin Arnold LTD appointment by the value of
£30,722.20 (inclusive of VAT).
The programme timetable for this scheme has
extended by 8 months to 26 June 2024 compared to the milestones
provided at tender stage.
Martin Arnold has procured and managed several sub-contractors
(principally undertaken site surveys and necessary due diligence
and forming part of the design and engineering team) during the
design and planning stages the scale of this was not envisaged at
tender stage.
The Council could refuse the uplift in fee,
this has been rejected because it is not reasonable to not consider
appropriate requests for additional fees in line with the terms of
the contract and would likely result in a legal challenge or a
termination notice from the consultant. The value is reasonable for
the extra services provided.
The other option considered was not to award this appointment at
all. This would not support the delivery of the Council’s
commitment to deliver four homes at Topham Square/Risley
Avenue.
