To authorise the Head of Legal Services to
prepare and seal a S.247 Agreement Under the Town and Country
Planning Act 1990 in relation to the Stopping Up of two small
sections of footway on the Hale Road and Station Road frontages of
1 Station Square. The legal fees and cost associated with the
agreement is to be paid by the applicant.
Reasons for the decision:
Authorisation is being sought for the stopping
up of two small areas of adopted highway under s247 of the Town and
Country Planning Act 1990 in order that the proposed development
can be built in accordance with the approved plans. The Stopping Up
application relates to the development at 1 Station Square, which
was granted full planning consent by London Borough of Haringey on
10thAugust 2018. The planning application reference is
HGY/2017/3923 and the applicant is Newlon Housing Trust.
The areas to be stopped up consists of two small areas of footway
that represent an anomaly between the boundary line of the property
as shown on the title plan and the positioning of the back edge of
the footway, which has changed in recent years. In terms of
location, one area is located at the eastern corner of the proposed
building on the Hale Road frontage of the building with the other
stopping up area being adjacent to a central column on the Station
Road frontage. The areas to be stopped up are shown on the attached
drawing reference A11390-E0-005-P1 and the 1 Station Road Stopping
Up Plan. The dimensions of the areas to be stopped up are: Eastern
corner – 420mm x 280mm; and Central column on Station Road
– 90mm x 1,720mm.
The stopping up will ensure that the outer edge of the structural
columns supporting the eastern end and central southern section is
positioned in accordance with the approved plans. These two areas
to be stopped up represent a very small and insignificant
proportion of the overall width and area of the adjoining footway
in Hale Road and Station Road and will have no effect on the
functioning of these footways and their suitability for pedestrian
movement.
The only objection to the order was received from Virgin Media.
Their objection to the Stopping Up Order was received by email on
6th August 2018. In their email to the Council’s lawyer
(Robert Walker), Virgin Media stated that they require a Wayleave
agreement to be signed or if it transpires that their apparatus
would need relocating or demolishment due to the development, their
Network Alterations Centre should be contacted. However, following
dialogue with the developer, Virgin Media has withdrawn their
objection. An email confirming the withdrawal of their objection
was received by the Council’s lawyer (Robert Walker) on 13th
September 2018.
