Decision:

To authorise the Head of Legal Services to prepare and seal a S.247 Agreement Under the Town and Country Planning Act 1990 in relation to the Stopping Up of a section of footway on Monument Way, which is within the demise of Transport for London’s (TfL) Highway. The legal fees and costs associated with the agreement is to be paid by the applicant.

Reasons for the decision:

Authorisation is being sought for the stopping up under s247 of the Town and Country Planning Act 1990 in order that the proposed development can be implemented in accordance with the approved plans. The Stopping Up application relates to the development at Land north of Monument Way and South of Fairbanks Road, which was granted full planning consent by London Borough of Haringey on 21st December 2017. The planning application reference is HGY/2016/2184 and the applicant is Newlon Housing Trust. The Notice of Planning Permission is included in the documents attached to this report.

The area to be stopped up consists of a narrow section of shared footway (for pedestrians and cyclists) in Monument Way. The area measures 154m in length with varying widths along its length, ranging from less than 1m to 6m at its widest point. This area is shown on the attached plan (Drawing No. 101 02 Rev. P1.)

Stopping Up of the existing shared footway (for pedestrians and cyclists), located along the northern side of Monument Way was identified under the consented development, to facilitate the realignment of Fairbanks Road, removal of an existing brick boundary wall and public realm improvements between Fairbanks Road and Monument Way, aimed at improving permeability for pedestrians and cyclists. It should be noted that additional highway improvements in Monument Way, complementary to the public realm improvements to be implemented in the subject area, will be delivered as part of the s278 highway Works for Monument Way – agreed under the consented development.

The proposed stopping up of the section of adopted highway concerned has no implications for the Council, as Highway Authority, financial or otherwise. The area to be stopped up is part of Transport for London’s highway and once it is stopped up it will be included within the demise of the consented development, and as such, maintenance will be at the expense of the developer.
