For the Director of Culture, Strategy and Engagement to approve a
variation of contract to Niblock (Builders) Ltd for
£63,680.33 varying the contract sum from £589,959.67 to
£653,640 as allowed under Haringey’s Contract Standing
Orders 3.01d and 10.02.1a.
Cabinet Member approved an award of contract
to Niblock (Builders) Ltd on 15th December 2022. This award
included a waiver of contract standing orders under 3.01d which
delegated authority to the Director of Culture, Strategy &
Engagement to approve any subsequent variation within the project
and programme budget up to and not exceeding Directors financial
threshold level of £500,000. On this basis the variation of
contract is presented to the Director of Culture, Strategy and
Engagement for consideration.
The scope of the project has varied during the construction phase
of the project. These changes have been approved under change
control procedures, on this basis the Council are obligated to
increase the value of the contract to support payment of
invoices.
Having a contractor on site to undertake what have been considered
essential variations benefits the council in terms of time and
cost. A change on contractor would not offer the council value for
money. Additionally, sharing the site between two different
contractors raising challenges under H&S and CDP
regulations.
